These terms of use ("these Terms") form a binding agreement between you and PMN Ventures ("we", "us") governing your use of the Poemlight app, website and services (together, "Poemlight" or "the Service"). By downloading, accessing or using Poemlight you agree to these Terms. If you do not agree, please do not use the Service.
1.Definitions
- "Poemlight" means the Poemlight mobile application, progressive web app and marketing website, in each case as operated by us.
- "Content" means all material available through Poemlight, including poem texts, audio readings, artwork, icons and documentation.
- "Device Data" means preferences and usage records stored on your device by Poemlight (favourites, listening history, chosen voice, playback position and similar).
- "App Store" means Apple's App Store or Google Play, as applicable.
2.Licence to use
Poemlight is provided free of charge. We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Poemlight for personal, non-commercial purposes. This licence does not transfer ownership of any part of the Service to you.
3.Intellectual property
The poems made available through Poemlight are in the public domain. The audio readings, app design, code, artwork, branding and all other Content are © PMN Ventures (or our licensors), all rights reserved.
You may not copy, redistribute, resell, sublicense, extract in bulk or commercially exploit the Content or any part of the Service, except where this is permitted by law or with our prior written permission. You may not use the Content to train machine-learning or AI models without our permission.
4.Acceptable use
You agree not to:
- disrupt, overload or interfere with the Service, its hosting or its infrastructure;
- attempt to gain unauthorised access to any part of the Service, its hosting or related systems;
- circumvent any technical protections or usage limits (except where such acts are permitted by applicable law);
- use the Service for any unlawful purpose.
5.Age and audience
Poemlight is intended for a general audience. We collect no personal data — including age — from anyone, so we do not verify ages. If you are under 13, please use Poemlight with a parent or guardian's permission.
6.Your device data
Your Device Data is stored only on your device and is never transmitted to us. You are solely responsible for it: we do not back it up, sync it or recover it. Clearing the app's storage, uninstalling the app or resetting your device deletes it permanently. See our Privacy Policy.
7.Third-party services
Poemlight is distributed through App Stores and relies on third-party hosting, content delivery networks and operating-system features (such as notifications). Those third parties' own terms apply to their services. Where you download Poemlight from an App Store, matters relating to that store — including any purchases and refunds — are governed by that store's terms as well as these Terms. We are not responsible for third-party services.
8.Availability and changes to the Service
We aim to keep Poemlight available but do not guarantee uninterrupted access. We may add, change, suspend or discontinue any part of the Service at any time, including features or Content. Where a change significantly reduces what the Service does, we will say so in the app's changelog.
9.Paid features
Poemlight is currently free. If we introduce optional paid features (such as collections or lifetime unlocks), they will be offered through the App Stores, will be governed by that store's payment terms and by any additional terms shown to you before purchase, and your statutory consumer rights (including under the Consumer Rights Act 2015) will apply in full. We will update these Terms and the date above if that happens.
10.No warranty
Poemlight is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy or non-infringement — to the fullest extent permitted by law. This does not affect your statutory rights as a consumer: nothing in these Terms excludes or limits your rights under the Consumer Rights Act 2015 or any other rights that cannot lawfully be excluded.
11.Limitation of liability
To the maximum extent permitted by law, our total liability arising out of or in connection with your use of Poemlight shall not exceed £100. We are not liable for indirect or consequential loss, or for loss of data stored on your device.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.
12.Indemnity
You agree to indemnify us against loss arising from your breach of these Terms or your unlawful use of the Service, to the extent permitted by law and subject always to the protections in clauses 10 and 11.
13.Events beyond our control
We are not liable for failure to perform obligations caused by events beyond our reasonable control, including internet or hosting failures, strikes, action of public authorities, or natural disasters.
14.Changes to these Terms
We may update these Terms from time to time. The current version always lives at this page with the date of the last update above. If a change is significant we will also note it in the app's changelog. Continuing to use Poemlight after a change means you accept the updated Terms.
15.General
- Entire agreement. These Terms (with any additional terms applying to paid features) are the whole agreement between us regarding Poemlight.
- Severability. If any clause is found unenforceable, the rest remains in force, and the unenforceable clause is replaced by an enforceable one closest to the original intent.
- No waiver. Not enforcing a right once does not waive it.
- Assignment. We may transfer these Terms (for example, to a successor business). You may not.
- Third parties. Except under clause 7, no one other than you and us may enforce these Terms (Contracts (Rights of Third Parties) Act 1999 excluded).
- Electronic communication. We communicate with you electronically via the app, the website or the contact address below.
16.International availability, governing law and disputes
Poemlight is offered through app stores in the United Kingdom, the European Union, the United States and elsewhere. We make no representation that the Service is appropriate or available for use in every country, and you are responsible for complying with local law.
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have non-exclusive jurisdiction over disputes between us.
If you are a consumer, this clause does not reduce your local protections. Wherever you live, you keep the benefit of the mandatory consumer-protection laws of your country of residence — including, if you are in the EU/EEA, the protections that apply in your home country — and you may bring proceedings in your local courts where local law allows.
